Terms of Use
The terms that govern your use of the Babysteps Network.
These Terms of Use ("Terms") govern your access to and use of the Babysteps Network — the platform, website, broker MLS, public property portal and related services (together, the "Platform") operated by Babysteps Real Estate SL ("Babysteps", "we", "us"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
1. Who we are
The Platform is operated by Babysteps Real Estate SL, Calle del Pozo 1, 03769 Benimeli (Alicante), Spain, company registration (CIF/NIF) B24778540. You can reach us at info@babysteps-re.com.
2. What the Platform is — and what it is not
Babysteps is a network that connects real estate professionals with one another and with the public, and lets members publish and discover properties across borders. We are a connector, not a party to any transaction. We do not buy, sell, let, value or broker property ourselves, we are not an agent or representative of any member, and we are not party to any agreement two members reach. Any deal, collaboration, commission or split is arranged directly between the members involved, on terms they agree themselves. Babysteps takes no commission and imposes no split.
3. Eligibility & accounts
- Member accounts are for real estate professionals and businesses. You must provide accurate information and keep it up to date.
- You are responsible for your account, your login credentials and all activity under your account. Tell us promptly if you suspect unauthorised use.
- You must be at least 18 and able to enter into a binding contract. The Platform is not intended for children.
- You are responsible for holding any licence, registration or authorisation required to act as a real estate professional in your jurisdiction.
4. Membership, credits & payments
- Some features require a paid membership or credits. Prices, membership tiers and what each includes are shown at sign-up or in your account.
- Payments are processed by our payment provider (Stripe). By subscribing you authorise the applicable recurring or one-off charges.
- Memberships renew for the committed term unless cancelled in line with your plan. Credits and badges purchased are, unless stated otherwise or required by law, non-refundable once issued or used.
- Your statutory consumer rights, where they apply, are not affected by this section.
5. Listings & your content
- You are solely responsible for the listings, photos, descriptions and other content you publish. It must be accurate, lawful, not misleading, and something you have the right to publish.
- You must have the necessary rights and permissions (including from property owners and for any images) and comply with all applicable real-estate, advertising, consumer and data-protection laws.
- You keep ownership of your content. You grant Babysteps a licence to host, display, distribute and promote it on the Platform and public portal for the purpose of operating the service.
- We may remove or suspend content that breaches these Terms, the law, or the rights of others.
6. Badges & verification
Badges recognise a member’s track record and require proof of the transaction they represent. You must not claim, buy or display a badge you cannot substantiate. We may request evidence, and we may withdraw badges or suspend accounts where a claim is unproven or misleading. Badges are a credibility marker and an administrative matter — they are not a warranty by Babysteps about any member or transaction.
7. Dealings between members
When members collaborate, contact each other, or complete a transaction, they do so at their own risk and on their own terms. Babysteps is not responsible for the conduct, performance, honesty or solvency of any member or user, for the accuracy of any listing, or for the outcome of any deal. Any dispute between members is between them; we may, but are not obliged to, help resolve it.
8. Acceptable use
You agree not to:
- Post false, fraudulent, unlawful, infringing or misleading content;
- Scrape, harvest or misuse other users’ data, or use it for unsolicited marketing;
- Circumvent access controls, security, verification or payment;
- Upload malware, disrupt the Platform, or attempt unauthorised access;
- Impersonate others or misrepresent your identity or authority;
- Use the Platform for any unlawful, discriminatory or harmful purpose.
9. Intellectual property
The Platform itself — its software, design, brand, name and logo — belongs to Babysteps and is protected by law. You may use it only as permitted by these Terms. Nothing here transfers our intellectual property to you, and nothing transfers your content to us beyond the licence in section 5.
10. Third-party services & partners
The Platform relies on third-party services (for example payments, hosting, email and maps) and may offer introductions to legal partners such as lawyers or notaries. We are not responsible for third-party services or for advice given by independent partners; your dealings with them are subject to their own terms.
11. Availability & “as is”
We work hard to keep the Platform available and reliable, but we provide it “as is” and “as available”. We do not guarantee uninterrupted or error-free operation, and we may change, suspend or discontinue features. We will give reasonable notice of significant changes where we can.
12. Liability
To the fullest extent permitted by law, Babysteps is not liable for indirect or consequential loss, lost profits or lost opportunities, or for loss arising from dealings between members or from content posted by users. Nothing in these Terms excludes liability that cannot lawfully be excluded — including your mandatory statutory rights as a consumer where they apply.
13. Suspension & termination
You may close your account at any time. We may suspend or terminate access if you breach these Terms, misuse the Platform, or where required by law. On termination, the licences you granted for content already displayed may persist only as needed to wind down the service; your data rights under our Privacy Policy continue to apply.
14. Governing law & disputes
These Terms are governed by Spanish law, without prejudice to the mandatory consumer-protection rules of your country of residence within the EU. Disputes are subject to the competent courts of Alicante, Spain, unless mandatory law gives you the right to bring proceedings elsewhere.
15. Changes to these Terms
We may update these Terms as the Platform evolves or the law changes. We will post the updated version here with a new “Last updated” date and, for material changes, notify members. Continued use after changes take effect means you accept the updated Terms.
